1. Acceptance of Terms

By downloading, installing, or using the Inner Echo mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Inner Echo is a personal affirmation and meditation application that allows you to record, organize, and play back guided affirmations and meditations. The App provides tools for creating custom content, organizing recordings into packs, and playing content with ambient audio.

3. Service Availability and Changes

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including the availability of any features or content. We may also impose limits on certain features or restrict access to parts or all of the Service without notice or liability.

The App and its features are provided on an "as is" and "as available" basis. We do not guarantee that the Service will always be available, uninterrupted, or error-free.

4. Pricing and Payment

Inner Echo is currently offered free of charge. We reserve the right to introduce paid features, subscriptions, or in-app purchases in the future. Any changes to pricing will be communicated through app updates and announcements within the App.

For users who begin using the App while it is free, we may offer promotional access or grandfathered pricing when paid features are introduced, but this is not guaranteed and is at our sole discretion.

If we introduce paid features:

  • All purchases are processed through the Apple App Store
  • Pricing and billing terms will be clearly disclosed before purchase
  • You agree to pay all applicable fees and taxes
  • Refunds are subject to Apple's refund policy

5. User Content and Data

Your Recordings

All recordings you create in the App ("User Content") are stored locally on your device. You retain all ownership rights to your User Content.

User Representations and Warranties

By creating and storing User Content in the App, you represent and warrant that:

  • You own or have the necessary rights, licenses, consents, and permissions to use and authorize us to use all User Content
  • Your User Content does not and will not infringe, misappropriate, or violate any third party's intellectual property rights, privacy rights, publicity rights, or other personal or proprietary rights
  • Your User Content does not contain any material that is unlawful, defamatory, obscene, or otherwise objectionable

Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

Prohibited Content

You agree not to create or store User Content that:

  • Violates any law or regulation
  • Infringes on intellectual property rights of others
  • Contains malware or harmful code
  • Is intended for distribution or commercial use (the App is for personal use only)

6. Intellectual Property

Our Rights

The App, including its design, features, functionality, text, graphics, and underlying code, is owned by InnerEcho and protected by copyright, trademark, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

You may not:

  • Modify, reverse engineer, or decompile the App
  • Remove any copyright or proprietary notices
  • Use the App for any commercial purpose
  • Create derivative works based on the App

7. Third-Party Services

The App may integrate with third-party services (such as analytics providers). Your use of these services is subject to their respective terms and privacy policies.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The App will meet your requirements
  • The App will be uninterrupted, timely, secure, or error-free
  • Any errors in the App will be corrected
  • The App is free from viruses or other harmful components

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL INNERECHO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the App
  • Any unauthorized access to or use of our servers
  • Any bugs, viruses, or other harmful code
  • Any content or conduct of any third party

10. Health and Medical Disclaimer

Inner Echo is a personal development and meditation tool. It is NOT a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical or psychological condition.

The App is not intended to treat, cure, or prevent any disease or condition. If you are experiencing mental health issues, please consult with a licensed mental health professional.

11. Indemnification

You agree to indemnify and hold harmless Inner Echo, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

  • Your use of the App
  • Your violation of these Terms
  • Your User Content
  • Your violation of any rights of another party

12. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last Updated" date at the top of these Terms and, where appropriate, through in-app notifications.

Your continued use of the App after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the App.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

15. Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if your claims qualify.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Inner Echo regarding the App and supersede all prior agreements and understandings.

19. Apple-Specific Terms

Acknowledgment

You acknowledge that these Terms are concluded between you and Inner Echo only, and not with Apple Inc. ("Apple"). Inner Echo, not Apple, is solely responsible for the App and its content.

Scope of License

The license granted to you is limited to a non-transferable license to use the App on any Apple device that you own or control as permitted by the Apple App Store Terms of Service.

Maintenance and Support

Inner Echo is solely responsible for providing maintenance and support services for the App. Apple has no obligation to furnish maintenance or support.

Warranty

Inner Echo is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.

Product Claims

Inner Echo, not Apple, is responsible for addressing any claims relating to the App or your possession or use of the App, including:

  • Product liability claims
  • Claims that the App fails to conform to legal or regulatory requirements
  • Claims arising under consumer protection or similar legislation

Intellectual Property Rights

In the event of any third-party claim that the App infringes that third party's intellectual property rights, Inner Echo, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.

Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
